TERMS OF SERVICE

The following are the terms and conditions of your use of the Lacey Bin Wash service, and which govern the rights and responsibilities between Lacey Bin Wash and you (“you” or “Customer”), as an authorized user of such services. These Terms of Service, together with any operating rules, policies, price schedules, or other supplemental documents expressly incorporated herein by reference and published from time to time by Lacey Bin Wash on its website (collectively, the Agreement) constitute the entire agreement between Lacey Bin Wash and you regarding the Services (as defined in this Agreement). By using the Service, you confirm your acceptance of, and agree to be bound by, this Agreement.


1. Services

Lacey Bin Wash provides on-site curbside residential cleaning for your municipally issued trash, yard waste and recycling bins and, also, provides other power washing services. (“Services”).  Trash bin cleaning services are offered as "Monthly" (every 4-6 weeks), "Bi-Monthly" (every 8-10 weeks), "Quarterly" (every 12-14 weeks), and "One-Time Cleaning" (single cleaning) plans. All bin cleaning plans include up to 2 bins. Additional bins may be added for an additional cost.


2. Responsibilities of Customer

To avoid an interruption or discontinuation of Services from Lacey Bin Wash, you must abide by the following conditions:

  1. All bins that you have scheduled for cleaning must be easily accessible (perferably curbside) to service personnel on scheduled service day. Your scheduled cleaning will happen the day AFTER your trash service company empties your bins. You will receive a text and/or email reminder from Lacey Bin Wash of your scheduled service.

  2. If your bins will not be available for your scheduled cleaning, please notify Lacey Bin Wash by 8:00 PM on the night before your scheduled cleaning to avoid any fees.

  3. You are not allowed to switch bins between cleanings. ie if you sign up for trash and yard bins, the recycle bin cannot be substituted in. Let us know if you would like us to clean your third bin at some point during your service period and we can add the third bin for a small fee.

  4. All bins must be emptied of trash and debris. Small "stuck-on" trash is ok and can be cleaned. Any larger trash items found we will attempt to re-bag and place back into your bin after your cleaning service.

  5. Animal feces must be in a tied or sealed bag before being placed in your trash bin. No un-bagged cat litter.

  6. All bins must be free of hazardous items, like hypodermic needles.

  7. All bins must be free of chemicals, fresh paint, glue or other adhesive, or hazardous waste of any kind.

  8. All bins must be free of building materials, e.g. plaster, stucco or concrete.

If you fail to observe the conditions listed above, we have the right to refuse providing you with the Services, but you will still be responsible for any and all payments/fees relating thereto. If you contact us within 5 days of your missed service, we will attempt to reschedule your missed service. Your next service date will commence as usual.


3. Responsibilities of Lacey Bin Wash

If we fail to provide your scheduled Services for any reason other than your failure to meet the obligations as outlined in section 2 above, Lacey Bin Wash will compensate the you by one of the following methods at its sole discretion:  reschedule service with you, credit your account to be used at a later date or extend our service contract by one cleaning. If we are unable to reschedule the Services with you, we will extend your service contract. If we are unable to provide your Services due to inclement weather, we will make good faith efforts to reschedule your Services.

Some bins may require multiple visits to get them properly cleaned. 

Lacey Bin Wash does not operate services on holiday weeks where trash service is disrupted.


4. Modification of Services

Lacey Bin Wash reserves the right to modify the Services at any time.


5. Modification of Terms of Service

This Terms of Service may be amended and/or revised at any time by Lacey Bin Wash by posting an amended and/or revised version of the same on our website (www.laceybinwash.com), or delivering a copy of the amended or revised Terms of Service to your email address on record. Lacey Bin Wash will welcome all inquiries, questions, and comments regarding any changes made to, or changes needing to be made to, the Terms of Service. Our goal is to always serve our Customers to the best of our ability and any changes to the Terms of Service would be solely made for the betterment of the Service program.


6. Payment

You agree to pay all charges for your use of the service at the prices  then in effect. You are also responsible for all taxes associated with the Services which we are legally required or permitted to collect from you. Lacey Bin Wash reserves the right to, at any time, change the prices or institute new charges at its sole discretion. Customers will be notified of any price changes by mail or email at least 30 days prior to the effective date of the change. Your continued utilization of the Services, or failure to terminate your account with Lacey Bin Wash after being notified of the pricing change, will be conclusive evidence of your acceptance of the modified prices.

Each Service plan can be paid for by using a credit card, debit card, or check (Payment Method.) If you wish to pay by credit card it will be requested of you to keep your card on file with Lacey Bin Wash. After each Service is performed your credit card on file will be charged (unless you have opted for the prepaid service (see below section 8).) By saving a credit or debit card on-file with us, you authorize Lacey Bin Wash to charge your Payment Method after each provided Service based on your service plan. If you opt to pay via check or not keep your credit or debit card on file, you will receive an invoice for Services which must be paid in advance of providing agreed Service.

If the issuer of your credit or debit cards does not remit payment to Lacey Bin Wash, Customer agrees to pay all amounts due upon demand by Lacey Bin Wash, including any and all fees relating to the delinquent payment.

Customer must notify Lacey Bin Wash of any changes to Customer’s Payment Method prior to the next billing cycle. Lacey Bin Wash reserves the right to suspend or terminate your service without notice upon rejection of any Payment Method or if your card issuer (or its agent or affiliate) seeks return of payments previously made to Lacey Bin Wash when Lacey Bin Wash believes you are liable for the charges. Such rights are in addition to, and not in lieu of, any other legal rights or remedies available to Lacey Bin Wash.

Any Customer account that is more than 30 days past due will be considered delinquent. Services for delinquent accounts will be suspended until the account balance has been restored to good standing.

8. Prepaid Services

Prepaid Services are paid upfront for a year's worth of cleanings. Available prepaid Service plans are for: "Monthly," or 13 services performed once every 4-6 weeks; "Semi-Monthly," or 8 services performed once every 8-10 weeks, and; "Quarterly," or 4 services performed once every 12-14 weeks. Payments for Services are provided upfront before your first cleaning. After the end of your prepaid service, you will receive a renewal notice. If you would like to renew, change, or cancel your prepaid Service, please contact us.


9. General

  • The failure of either party to enforce its rights under this Agreement at any time for any period shall not be construed as a waiver of such rights.

  • If any part, term or provision of this Agreement is held to be illegal or unenforceable neither the validity nor enforceability of the remainder of this Agreement shall be affected.

  • Neither Party shall assign or transfer all or any part of its rights under this Agreement without the consent of the other Party.

  • This Agreement constitutes the entire understanding between the Parties relating to the subject matter hereof unless any representation or warranty made about this Agreement was made fraudulently and, saves as may be expressly referred to or referenced herein, supersedes all prior representations, writings, negotiations or understandings with respect hereto.

  • Neither Party shall be liable for failure to perform or delay in performing any obligation under this Agreement if the failure or delay is caused by any circumstances beyond its reasonable control, including but not limited to acts of god, war, civil commotion or industrial dispute. If such delay or failure continues for at least 30 days, the Party not affected by such delay or failure shall be entitled to terminate this Agreement by notice in writing to the other.


10. Discounted "Share to Save" Services

  • When a "share to save" offer is presented on social media, you must contact us via a comment or a message after you have shared the post to receive the discount.

  • Your name will be recorded. If you are an existing customer you will be given your next cleaning service at the advertised discounted rate. If you have prepaid for the service, we will either add an additional cleaning onto your service, or discount your renewal appropriately

  • For new customers, you will be given your first cleaning at the discounted rate. If you choose to pay in full for a year, we will apply the discount appropriately to your yearly cost, or add an additional cleaning.
